Why your Los Angeles ADU project gets stuck in permitting

Backyard accessory dwelling unit under construction in Los Angeles

Most Los Angeles ADU permits stall on the same handful of issues: zoning math, hillside geology, fire access, and incomplete plan sets. Here's how to clear them.

Most Los Angeles ADU permits stall on the same handful of issues: zoning math, hillside and fire-zone overlays, historic review, and incomplete plan sets. Each has a different fix, and guessing at the wrong one costs months.

An ADU permit that sits in plan check is rarely sitting for one mysterious reason. LADBS plan check is a checklist process, and a stalled application usually has one or more checklist items unmet: a zoning standard that does not work on that lot, a clearance that was never routed, a plan sheet that does not answer the reviewer's question, or a utility condition that was never checked. Naming the actual stall is the whole job.

The zoning math that kills permits before they start

Setbacks, height, lot coverage, and floor-area limits decide ADU size before design does. State law guarantees that an ADU of up to 800 square feet with 4-foot side and rear setbacks must be approved regardless of lot-coverage and floor-area limits, and conversions of existing garages and accessory structures keep their existing setbacks. Beyond those floors, the parcel's zone and height district govern, and a design that exceeds them will not be cured by a nicer rendering. Check the zone, the height district, and the applicable setbacks in ZIMAS before drawing the unit, not after the first plan-check correction.

Hillside, fire-zone, and HPOZ overlays

Three overlays routinely surprise ADU applicants. In hillside areas, slope, grading, soils and geology review, and fire-access rules shape what can be built and where. In a Very High Fire Hazard Severity Zone, Chapter 7A hardening, defensible-space, and access requirements apply, and the City's adopted fire map and the state's 2025 Local Responsibility Area recommendations can show different results for the same parcel, so both must be checked. In an HPOZ, the ADU itself remains ministerial under state law, but exterior design review still applies to style, roof form, and materials, which makes the path design-sensitive and longer. A pre-approved LADBS standard plan shortens building-code plan check; it does not waive any of these clearances.

What a complete plan set looks like

Incomplete plan sets are the most fixable stall and the most common one after zoning. A complete set answers, on its face: site plan with setbacks and easements, floor plan and elevations, structural and foundation details for the site's soils, Title 24 energy compliance for the new conditioned space, plumbing, electrical, and mechanical scopes, and utility connections for sewer, water, and electrical service. Missing any one of those invites a correction cycle, and each cycle restarts part of the review clock. The state decision clock for a complete application — approval or denial within 60 days, with a written completeness determination within 15 business days — only helps once the application is actually complete, which is why completeness is a strategy, not a formality.

Utilities and the stalls nobody budgets for

Sewer capacity and lateral condition, water service size, and electrical panel and service capacity are checked late in many projects and should be checked first. A sewer lateral that needs replacement, a water service that cannot serve a second unit, or a panel that cannot carry the ADU's load each add scope, fees, and time that no finish selection can offset. Tenant and rent-stabilisation rules add a further gate where the primary building is covered: primary renovation work in a rent-stabilised building needs an accepted Tenant Habitability Plan before LADBS issues the permit. See our ADU construction page, our garage conversion page, and the ADU cost post in this blog, and for a flat-lot contrast, the Atwater Village and Van Nuys location pages describe where lot conditions favour a simpler path.

Frequently Asked Questions

Why does my ADU permit sit in plan check for months?

Usually one of four stalls: zoning math that does not work on the lot, an unrouted clearance for hillside, fire-zone, or HPOZ review, an incomplete plan set, or an unchecked utility condition. The correction letter names the actual stall.

Does a pre-approved LADBS plan guarantee a fast ADU permit?

No. A standard plan is pre-reviewed for building-code compliance, but site fit, soils, utilities, fire, and HPOZ review still apply to the parcel, and customisation can trigger review of the revised portions.

Can an HPOZ block my ADU?

An HPOZ does not give the city a discretionary denial right over a conforming ADU, but exterior design review still applies to style, roof form, and materials, which makes the path longer and design-sensitive.

What is the ADU decision clock in California?

State law requires a written completeness determination within 15 business days and a decision on a complete application within 60 days, with a missed deadline deeming the application approved. The clock helps only once the application is complete.
